REALTOR® Report – June 22, 2016 Edition

 Take Action! Tell the Senate to Get to Work for Future Homebuyers

All NDAR members are asked to respond to the current NAR Call for Action asking their U.S. Senators to pass H.R. 3700.  This legislation passed the U.S. House 427-0 with NO OBJECTIONS, but has failed to come up for a vote in the U.S. Senate.  This bill provides significant benefits to taxpayers, home buyers and the real estate market by:

  • Removing a burdensome and expensive FHA Condo approval process
  • Reducing FHA restrictions on the number of condos available to home buyers
  • Permanently streamlining Rural Housing Service loan processing

Governor Makes Appointments

Scott Breidenbach, Fargo has been appointed to the North Dakota Real Estate Commission and Corey Kost, Bismarck to the North Dakota Real Estate Appraiser Board.  Both terms will begin July 1.  We welcome them and thank Kris Sheridan and Joe Ibach for their many years of service to the Real Estate Commission and Appraiser Board respectively.  Congrats Scott and Corey!


 NDAR June Meetings Highlights

Nominating Taskforce – Interviewed candidates for the following positions and forwarded names to be on the ballot for election in September:

President Elect: Ben Schroeder, Fargo

Vice President: Amy Hullet, Bismarck and Lorrie Nantt, Dickinson

Also interviewed candidates for NAR Director (Dewey Uhlir term up end of 2016) and will forward to NAR for appointment Vicki Roller.

Also updated policies for task force and the nominating process


Executive Committee – Approved recommended bylaws change to change the category title for Affiliate Member to Business Partner.

Update on Core Standards (due June 30):

Recommend that NDAR be a Golden RPAC Investor


Building Taskforce – met jointly with the Executive Committees of both the North Dakota Association of Realtors and the Bismarck Mandan Board of REALTORS®.  Forwarded to both Board of Directors to set aside funds for new building and also to move forward with a remodel of the current space to accommodate the staff.  Each entity asked to invest $25,000 towards this project.  Both Boards have approved this.


Membership Involvement – Approval of the development of an informal YouTube video for New Committee Member Orientation.

HotelStorm approved as a new member benefit.  HotelStorm is hotel reservation site that offers rates of up to 30% less than other reservation sites.


Technology Committee – Approved committee name change to Cyber Alliance.

“PROTECHt Yourself” is the name of a quarterly online newsletter which will be sent to members and will contain tech-related information.


Professional Development – Advertising, Agency and Professional Courtesy were approved as 2017 Mandatory topics recommendations to the ND Real Estate Commission.  Approved a recommendation to the Board to establish a Presidential Advisory Group (PAG) to explore the need for pre- and post-licensure education and provide a recommendation to the board.


Government Affairs – Debbie Kroshus, Burleigh County Recorder, updated members on what the ND County Recorders Association is doing to comply with a legislative request to investigate setting a flat fee for recording documents and to include affected parties (REALTORS, Title Companies, etc.)  A $75 fee had been proposed but interested parties objected as too high, so work continues, the committee approved printing a card which summarizes our Public Policy, which can be used at Legislative Impact Day and by REALTORS and local boards to educate the public about NDAR.  The June primary ballot language and interim committee updates were reviewed and NAR Committee members shared highlights from their committee meetings in May in D.C.  Members heard about the NAR Consumer Advocacy database and criteria for its use and Karl Eckhart in his federal update alerted members to a Call for Action to the Senate on HR 3700 that will run through July and said work continues in preparation for re-authorization of the National Flood Insurance Program.


RPAC Fundraising – We are at 77% participation in RPAC by members of all NDAR committees.  Goal is 100%.  We are at 51% total RPAC/Issues member participation.  Goal is 75%.  The Bismarck Mandan Board of REALTORS was the first board in the state to use NAR’s Phone Bank to solicit RPAC investments from non-givers.  They shared lessons learned and every local board was encouraged to also do a Phone Bank.  To date we have met 2016 President’s Cup criteria, but for Triple Crown we still need to do a broker education and promote 100% voter participation among REALTORS in the November election. Everyone was reminded that the RPAC reception at convention is open to those that have contributed a minimum of $250 to RPAC or Issues and one guest.  The exception is attendees where the guest also is an NDAR member, then they both have to have given $250.  NAR committee members shared highlights from their committee meetings in May in D.C.

 REALTOR® Party Members…Use Your Right to Vote!

To increase REALTOR® participation and influence in the political process the National Association of REALTORS® (NAR) has initiated a Voter Initiative.  NAR and NDAR are urging all REALTORS® to get out and vote in November.  We would like to be able to say that 100% of our member REALTORS® cast their ballots at the polls!  In North Dakota, you can take advantage of voting by mail or early voting in certain precincts. and plan to get out and vote!


FAA Releases Final Rule on Unmanned Aerial Systems (Drones)

The Federal Aviation Administration just released the final rule governing small UAS’s (drones).  A few highlights: small drones 55 lbs. or less only may be flown by certified pilots age 16 years or older; the drone has to be in line of sight; cannot be flown over 400 ft; certification requires taking a test requiring some aeronautical knowledge; TSA will conduct a background check before a certificate is issued; drones are restricted from flying too close to airports, flying at more than 100 mph and engaging in reckless operations

or from flying directly over people not involved in the drones flight operations.  This link will take you to a summary of the new rule which becomes effective in late August.
